I would like to see a new law put in place, and maybe you can articulate more on the specifics, but the concept is fairly simple:
Law Enforcement officers, Police, Cops, or any other person in a position of authority who abuses their authority and makes an arrest, restricts another free movement, or violates another's right of free movement in a manner in which was brought upon by personal emotion, be arrestable offense.
Basically, any Police Officers that makes an arrest that is without merit (False Arrest), because they became personally involved in the incident, then they are to be arrest themselves.
How many times have we all seen videos of a Cop who arrest a person for simply talking back to them. They make things up on their police report just to justify their False Arrest! This is not what Police Officers are hired to do, they are not to take their job personal, but enforce the laws that are in place.
They must have forgotten that they are Public Servants, paid by our tax dollars, and therefore are responsible to the community. They are not above the law, and they are not the law.
I want to see criminals arrest, just like the next person, but when there are Cops out there taking things personal and making False Arrests, it is not just a waste or our tax payers money but a violation of our rights!
Just think about it, some Cop is having a bad day and pulls you over for speeding. as he approaches you window, you ask "what did you stop me for"? He now snaps an attitude and tells you to give him your license, vehicle registration, and insurance. You again ask, and have the right to do, "why were you stopped"? The Cop does not think that you are complying and now pulls you out of the car and says you are under arrest for resisting arrest. Sure this sounds ridiculous, but it does happen! You have done nothing wrong other than what you have the right to do. Police Officers must tell you why they have restricted your FREE movement! They can't just "detain" you.
If you watch some of the videos on our site you will see this happening too many times. There is one video where one Texas Cop arrested a News reporter for trying to report an accident. Since when can you not video tape something in public? Who gave this Cop the authority to create his own laws, tell this News Reporter that he could not record video? He took things personal and made an arrest on the News Reporters, he should not be arrested and face the consequences of his actions.
I feel that a law like this would create a better check and balance system for Police Officers. As it stands tight now, a Cop arrests you for anything, and after spending money on having to defend yourself against this False Arrest, all you can do is try to file a lawsuit against the Police department. Nothing is done to the Officer. And if you win that lawsuit, once again the community is the one who has to pay!
We need honest Police Officers, who are responsible and accountable for their actions!
