Have you received a Notice of Violation from the City of Pembroke Pines for running a red light and having been caught on one of the cameras?
I have not received one of these City of Pembroke Pines Notice of Violation yet, but a friend did and I had to look into this.
The Notice of Violation states: In Violation of Florida Statute 316.0083, 2(1) and 316.075(1)(c)1. Then on the rear of the violation it states that if you don't pay the $158 a UTC (Uniform Traffic Citation) will be issued and additional fees incurred.
So let's review these Florida Statutes:
- 316.0083 Mark Wandall Traffic Safety Program; administration; report. This statute refers to the Red Light Camera program, and basically contain the information on the rear of the Violation.
- 316.074 Obedience to and required traffic control devices.— (1) The driver of any vehicle shall obey the instructions of any
official traffic control device applicable thereto, placed in
accordance with the provisions of this chapter, unless otherwise
directed by a police officer, subject to the exceptions granted the
driver of an authorized emergency vehicle in this chapter.
- 316.075 Traffic control signal devices.—
(c) Steady red indication.—1. Vehicular traffic facing a steady red signal shall stop
before entering the crosswalk on the near side of the intersection or,
if none, then before entering the intersection and shall remain standing
until a green indication is shown; however
I have a few concerns about this:
The Pembroke Pines Police department is issuing a "Notice of Violation", and if that notice is not paid, then you receive a UTC (Uniform Traffic Citation) - So, why not issue a UTC in the first place - was the violation not sufficient to deserve a Traffic Citation? Or is this an idol threat from the city of Pembroke Pines. How much legality does this have?
What if you can't say who exactly was driving the vehicle when the "infraction" was observed by a camera? What if I loaned my car to a friend who in turn allowed another friend of his drive the vehicle and that person committed the infraction? What I let someone test drive my vehicle?
Are Police Vehicle, City Commissioners and other Public Officials also receiving these infractions or are those automatically discarded?
What if one of these people photoshop some of these infractions?
I just feel there are too many loop holes in this legal system and would love to hear your opinion on this matter.
Is this just another way to "tax" us without calling it a tax, or is there a serious driving risk problem?
